1. Acceptance of these Terms
These Terms of Use ("Terms") govern your access to and use of thetechnologypulse.com (the "Site"), including all content, free tools, newsletters, and digital products offered through the Site (collectively, the "Services"), operated by The Technology Pulse ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy and Disclaimer, which are incorporated here by reference. If you do not agree to these Terms, please do not use the Site.
2. Eligibility
You must be at least 13 years old to use the Site. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may use the Site only with the involvement of a parent or legal guardian. By accessing the Site, you represent that you meet these eligibility requirements.
3. Use of the Site and Content
3.1 Permitted use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. You may:
- Read and view articles, guides, and reviews
- Use the free tools (PC Build Configurator, PC Tech Helper, PC Health Check) for personal purposes
- Subscribe to and receive our newsletter
- Share links to our content via social media, email, or similar channels
- Quote short excerpts (under approximately 200 words) for educational or commentary purposes, with attribution and a link to the source article
3.2 Prohibited uses
You may not, and you may not permit any third party to:
- Copy, reproduce, republish, redistribute, or modify our content in whole or in substantial part without our prior written permission
- Use automated systems (scrapers, bots, crawlers) to access, index, or copy the Site in ways that violate our robots.txt or that impose an unreasonable load on our infrastructure
- Use the content to train machine learning models, generative AI systems, or large language models without our prior written permission
- Reverse-engineer, decompile, or attempt to extract the source code of our tools beyond what is visible in your browser for personal use
- Frame, mirror, or redistribute the Site or substantial portions of it on another website
- Interfere with the Site's operation, attempt to gain unauthorized access to any part of the Site or its infrastructure, or transmit malware or other harmful code
- Remove, obscure, or modify any copyright, trademark, or other proprietary notice
- Use the Site for any unlawful purpose or in violation of these Terms
4. Intellectual property
All content on the Site — including articles, guides, reviews, photographs, illustrations, code snippets, the underlying website design, the logo and trademarks, and the digital products offered through the store — is owned by The Technology Pulse or its licensors and is protected by copyright, trademark, and other intellectual property laws. The license granted in Section 3 does not transfer ownership of any content to you.
Product names, brand names, and logos referenced on the Site for editorial purposes are the property of their respective owners; their inclusion does not imply endorsement.
5. Free tools and educational content
The Site offers free interactive tools (such as the PC Build Configurator and the PC Health Check) for general informational purposes. These tools provide guidance based on common configurations and generally accepted practices; they are not a substitute for professional advice or for verifying compatibility with specific manufacturer documentation. 6. Digital products and purchases
6.1 Order acceptance
When you place an order for a digital product through our store, your order is an offer to purchase. We reserve the right to decline or cancel any order in our discretion, including for suspected fraud, payment failure, pricing errors, or product unavailability. Payment is processed by our third-party providers (currently PayPal and Stripe); their terms apply to the payment transaction itself.
6.2 License to digital products
When you purchase a digital product (such as the PC Repair Business Starter Kit, the Maintenance Guide, or similar), we grant you a perpetual, non-exclusive, non-transferable license to use the materials for your personal or single-business use. You may print copies for your own use. You may not redistribute, resell, sublicense, or publicly post the materials. Where the product includes templates intended for use with your own customers (for example, intake forms or invoice templates), you may use those templates with your own clients in the ordinary course of business.
6.3 Updates
Some digital products include free updates within a stated period. Where updates are included, you will receive them via the email address associated with your purchase. We are not obligated to provide updates unless explicitly stated on the product page.
6.4 Refunds
We offer a 30-day refund window on digital products. If a product does not meet your reasonable expectations, contact us within 30 days of purchase at hello@thetechnologypulse.com with your order details and the reason for the refund request. We will issue a refund to the original payment method, typically within ten business days of approval. After 30 days, refunds are not available except where required by applicable consumer protection law.
7. Newsletter
By subscribing to our newsletter, you consent to receive periodic emails from us at the address you provided. Every newsletter email includes a one-click unsubscribe link. We do not share newsletter addresses with third parties for marketing. See our Privacy Policy for details on how newsletter data is handled.
8. User-submitted content
If you submit content to us through the contact form, by email, in response to a survey, or otherwise (for example, a question, a correction report, a testimonial), you grant us a worldwide, royalty-free, non-exclusive license to use, edit, reproduce, and publish the submitted content in connection with the Site and our content (for example, in an FAQ, a follow-up article, or a correction notice), with or without attribution. If you do not want your submission used in this way, please say so in the submission itself. Submissions must not include defamatory, infringing, or otherwise unlawful content.
9. Third-party links and services
The Site links to third-party websites and uses third-party services (hosting, analytics, payment processing, newsletter delivery, advertising, affiliate networks). We do not control those websites or services and are not responsible for their content, privacy practices, or availability. Your use of third-party websites and services is governed by their own terms and privacy policies.
10. Disclaimers and limitation of liability
The Site and all content are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
To the maximum extent permitted by applicable law, in no event will The Technology Pulse or its operators be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption) arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or related to these Terms or the Site will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages; in those jurisdictions, the above exclusions and limitations apply to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless The Technology Pulse and its operators from any third-party claim, demand, loss, or damages (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site in violation of these Terms, (b) your violation of any law or third-party right, or (c) content you submit to us in violation of these Terms.
12. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason — including violation of these Terms or extended inactivity. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
13. Governing law and dispute resolution
These Terms are governed by the laws of the United States and the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in the State of Colorado, and you consent to the personal jurisdiction of those courts. If you are a consumer resident in the European Economic Area or another jurisdiction that grants you statutory rights that cannot be waived, nothing in this section limits those rights.
14. Changes to these Terms
We may update these Terms from time to time to reflect changes in our practices, in our offerings, or in applicable law. When we do, we will update the "Last updated" date at the top of this page. Material changes will be highlighted on the homepage or sent to newsletter subscribers. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
15. Miscellaneous
These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the Site and supersede prior agreements on the same subject. If any provision is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
